European Court Obliged Russia To Pay 22 000 Euros to Tajik

The European Court of Human Rights decided on “Abdurazok Gaforov against Russia” case.
Abdurazok Gaforov is originally from Khujand. At the end of 2005 few people were arrested in Khujand on suspicion of being a part of Hizb ut-Tahrir, the prohibited Islamic party. Despite the fact that Abdurazok said he was never involved in this party, he was arrested in February of 2006. After being tortured for several months he managed to escape from the prison. In 2007 Abdurazok moved to Russia.

By the demand of Tajik authorities, Mr. Gaforov was detained in Moscow on August 5, 2008. He applied for refugee status, but got the rejection:..Prosecutor General order to extradite Mr. Gaforov within 15 days, not waiting for expiration of term, assigned by the law for appealing procedure, and ignoring the prohibited practice of sending refugees back to their countries of origin, approved both by Russian and international law.

Mr. Gaforov spent over 20.5 months in the remand prison in Moscow although, in accordance with Russian laws, he must have been allowed to spend there no more than 18 months. Therefore, Abdurazok was illegally imprisoned for over 1.5 years.

European Court assigned to compensate 15000 Euros to Mr. Gaforov for moral damage and 6825 Euros for litigation costs.

War on Terror Tajik-Style: Shave Those Beards

If you wear a beard in Tajikistan, you must be a terrorist. At least, that’s what some authorities appear to believe. In their latest effort to stamp out expressions of Islam in the country, police have begun detaining bearded men, according to local press reports.

Though the chairman of the State Committee for Religious Affairs has denied the existence of any injunction against beards, a recent article by Dushanbe’s Asia-Plus news agency documents testimony from several men detained for having beards. Muslim men often grow beards out of reverence for the Prophet Mohammed.
One (formerly?) bearded Dushanbe resident described his detention:

“[Police] explained that [my detention] was connected with anti-terror measures. Is it normal to see a terrorist in every bearded man? Logically, a terrorist would not wear a beard to avoid attracting attention, knowing how such people are being treated nowadays. However, what should we do, we who have no extremist views and are just fulfilling the sunnahs [following the practices of the Prophet]? For me the beard is a sunnah, which I want to and should fulfill. When I tried to explain that, they said that I could live in Pakistan, for example, if I am not satisfied with the laws of this country.”

Interior Ministry spokesman Mahmadullo Asadulloev confirmed that a campaign against men with long beards had begun. But he said it was only against suspected followers of Salafism, a strict form of Islam.
Asadulloev added that all “suspicious men” detained during the campaign would be freed after they were questioned, listed, and fingerprinted.

Европарламент Осудил Уголовное Преследование Орлова В Адрес Кадырова

Европейский парламент в четверг, 21 октября, подверг резкой критике уголовное преследование главы правозащитного центра “Мемориал” Олега Орлова, отметив, что Орлов является лауреатом Сахаровской премии прошлого года и в этой связи находится “под его моральной и политической защитой”.

B июле Орлову было предъявлено обвинение по уголовному делу о клевете на руководителя Чечни Рамзана Кадырова. Это было связано с тем, что правозащитник возложил на Кадырова ответственность за убийство российской правозащитницы, сотрудничавшей с “Мемориалом”, Натальи Эстемировой. В рамках гражданского процесса по этому делу суд уже приговорил Орлова и “Мемориал” к штрафу за посягательство на репутацию главы Чечни.

Депутаты парламента в Страсбурге потребовали незамедлительно прекратить уголовное дело против Олега Орлова, подчеркнув, что заявления, подобные тем, которые делал правозащитник, вполне легитимны в демократическом обществе. Депутаты также призвали российские власти покончить с “общим климатом безнаказанности и страха” на Северном Кавказе, где произвольные аресты и пытки являются обычным явлением, а систематические исчезновения правозащитников остаются по большей части безнаказанными.

Counterterrorism Operation Regime Introduced On October 20

Tyrnyauz town in Kabardino-Balkaria in Russia: The counterterrorism operation regime was introduced in this part if Tyrnyauz on October 20 at 19:00, Moscow time.

Criminal proceedings were instituted under the RF Criminal Code articles “attempt on the life of law enforcement officers” and “illegal weapons turnover.”

The militants’ group was spotted on October 20 during a special search operation to neutralise members of illegal armed groups in the territory of an abandoned tungsten-molybdenum plant. The militants then hid in one of the mines and were blocked. One militant was killed in the shootout, one policeman of the Ebrrus district police department was also killed and an OMON special police task force fighter from Volgograd was wounded.

Россия: Тюремные Сроки Должны Быть Понижены

Тюремные сроки по целому ряду уголовных преступлений, в том числе кражам и грабежам, должны быть понижены. А за совершение некоторых “легких” преступлений можно будет наказывать штрафом, отказавшись от исправительных работ.
Соответствующий законопроект обсудил вчера Дмитрий Медведев на совещании с представителями правоохранительных ведомств. В ближайшие дни проект будет официально внесен в Госдуму.

Двухлетняя практика, как заявил Дмитрий Медведев, показала, чтоназначение наказания, не связанного с лишением свободы, условного осуждения за преступления, которые не представляют большой общественной опасности, являются достаточно эффективными для исправления осужденных“.
Так, выделено 68 составов различных преступлений, по которым предлагается “исключить нижние пределы санкций в виде лишения свободы”. То есть речь идет о тюремных сроках.
