European Court Obliged Russia To Pay 22 000 Euros to Tajik

The European Court of Human Rights decided on “Abdurazok Gaforov against Russia” case.
Abdurazok Gaforov is originally from Khujand. At the end of 2005 few people were arrested in Khujand on suspicion of being a part of Hizb ut-Tahrir, the prohibited Islamic party. Despite the fact that Abdurazok said he was never involved in this party, he was arrested in February of 2006. After being tortured for several months he managed to escape from the prison. In 2007 Abdurazok moved to Russia.

By the demand of Tajik authorities, Mr. Gaforov was detained in Moscow on August 5, 2008. He applied for refugee status, but got the rejection:..Prosecutor General order to extradite Mr. Gaforov within 15 days, not waiting for expiration of term, assigned by the law for appealing procedure, and ignoring the prohibited practice of sending refugees back to their countries of origin, approved both by Russian and international law.

Mr. Gaforov spent over 20.5 months in the remand prison in Moscow although, in accordance with Russian laws, he must have been allowed to spend there no more than 18 months. Therefore, Abdurazok was illegally imprisoned for over 1.5 years.

European Court assigned to compensate 15000 Euros to Mr. Gaforov for moral damage and 6825 Euros for litigation costs.
